Terms of Service

1. Acceptance of Terms
By accessing or using the BuildWell AI Inspect platform ("Service"), operated by BuildWell AI Ltd ("Company", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not access or use the Service.
2. Description of Service
BuildWell AI Inspect is a cloud-based construction inspection management platform designed for UK building professionals, inspectors, and developers. The Service includes tools for scheduling inspections, recording site observations, generating compliance reports, and meeting obligations under the Building Safety Act 2022.
3. Account Registration
You must register for an account to access most features of the Service. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.
4. Free Trial
We may offer a free trial period (currently 14 days) for new accounts. At the end of the trial, you must subscribe to a paid plan to continue using the Service. We reserve the right to modify or terminate the free trial offer at any time without notice.
5. Subscription and Payment
Paid subscriptions are billed in advance on a monthly or annual basis. All prices are exclusive of VAT. You authorise us to charge your payment method on a recurring basis. Subscriptions auto-renew unless cancelled before the renewal date. Refunds are not provided for partial billing periods.
6. Acceptable Use
You agree not to use the Service to: (a) violate any applicable law or regulation; (b) upload content that is unlawful, harmful, or infringes third-party rights; (c) interfere with or disrupt the integrity or performance of the Service; (d) attempt to gain unauthorised access to the Service or related systems; (e) use the Service to generate false or misleading inspection records.
7. Data & Compliance
You retain ownership of all data you upload to the Service. By uploading data, you grant us a limited licence to process that data solely to provide the Service. We process personal data in accordance with our Privacy Policy and applicable UK GDPR obligations. You are responsible for ensuring that inspection records you generate meet any applicable statutory requirements, including those under the Building Safety Act 2022.
8. Intellectual Property
The Service, including its software, AI models, branding, and content, is owned by BuildWell AI Ltd and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes only.
9. Limitation of Liability
To the maximum extent permitted by law, BuildWell AI Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you shall not exceed the fees paid by you in the 12 months preceding the claim.
10. Termination
We may terminate or suspend your account at any time for breach of these Terms. You may cancel your account at any time via the account settings. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days post-termination before deletion, unless required by law to retain it longer.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or via the Service. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
